Disclaimer and Terms for Payment and Services.
The customer agrees to the following terms for service by Kyoto Computer Service.
Terms of Payment:
The Customer agrees to pay the quoted fee and any additional fees incurred at the completion of the requested work. The quoted fee includes traveling expense and the first two hours of work, and is determined by the customer's location of residence, complexity of work and parts involved. Thereafter, this is followed by an hourly rate calculated per 15 minutes.
Kyoto Computer Services reserves the right to charge the customer for any expenses and losses incurred when, irrespective of reason:
the customer has changed the time or cancelled the service without strictly 4 hours notice.
the customer has changed the time or cancelled the service while the serviceman is in transit.
the serviceman has arrived at the customer's residence and the customer then changes the time or cancels the service.
the customer is not present at their residence at the agreed appointment time.
Kyoto Computer Services also reserves the right to charge the customer for parts specifically purchased if the customer cancels the work.
Release of Liability:
Due to the unknown and variable status of quality and the complexity of integrated parts, software and hardware, including that of previous workmanship or future work intended at the discretion of the customer, and to necessitate the completion of requested work:
The customer agrees and acknowledges that Kyoto Computer Services provides no explicit or implied warranty or guarantee on services performed or parts provided, other than any existing manufacturer's warranty.
The customer agrees and acknowledges that Kyoto Computer Services will not be held responsible or liable for the potential risk, including loss or damage to customer’s home or office, computer hardware, cabling, hubs, routers, switches, peripherals, accessories, and furniture, as well as potential risk of damage, corruption, or loss of computer software, applications, data, and data storage media, but not limited only to this.
The customer agrees and acknowledges that Kyoto Computer Services will not be held responsible or liable for damage or loss as well as any incidental or consequential material or financial damage, before, during or after work has been completed.
The customer agrees and acknowledges to give Kyoto Computer Service representatives access and permission to physically disassemble any and all computer systems, components, networks, cabling, hubs, routers, switches, peripherals, and accessories when the customer is not present or available to obtain such authority in order to complete the requested work.
The customer agrees and acknowledges to give Kyoto Computer Services representatives access security rights, and permission to modify and manipulate specific computer software, applications, data and data storage media including, but not limited to the computer Operating System, and any other type of software or data that may be contained on the customer's computer system or network (i.e. open, view, edit, delete), when the customer is not present or available to obtain such authority in order to complete the requested work.
The customer has agreed and acknowledged to give Kyoto Computer Services representatives permission to physical access and presence in the customer's home or office property where the computer system and/or network exist when the customer becomes absent or is absent during the undertaking of requested work.
The customer agrees and acknowledges to give Kyoto Computer Services representatives, permission to perform necessary modifications to home or office property for the purpose of installing or troubleshooting computer and/or networking hardware, cabling, hubs, routers, switches or peripherals. Modification may require drilling through or disassembly and/or reassembly of furniture, walls, floors, carpet, or trim, laying and removing cabling and devices including affixing cabling and devices to furniture, walls, floors, or trim, using nails, screws, staples, hangers, or plastic ties when the customer is not present or available to obtain such authority in order to complete the requested work.
The customer agrees and acknowledges to give Kyoto Computer Services representatives permission to download and/or install software on the customer's computer and/or network, including but not limited to, virus scanners, diagnosis and repair utilities, drivers, libraries, and software requested to be installed by the customer in order to complete the requested work.
The customer agrees and acknowledges to give Kyoto Computer Services representatives permission to install hardware in the customer’s computer and/or network, including, memory chips, processor chips, cooling fans, batteries, hard drives, tape drives, storage devices, modem and communication devices, audio and video cards, network interface cards, hubs, routers, switches, printers, scanners, cables, (but not limited to this) and other hardware requested to be installed by the customer in order to complete the requested work.
The customer agrees to, and acknowledges that Kyoto Computer Services has strongly advised the customer to back-up and save any critical data prior to the commencement of any services. Unless specifically requested and provided as a paid service by Kyoto Computer Services, the customer is wholly responsible for any backup, archiving, or protective storage as well as restoration.
Kyoto Computer Services is an on site service and does not offer, imply availability, or provide off-site telephone technical support. This document constitutes an entire agreement between the customer and Kyoto Computer Services. No other agreement whether verbal or written shall be in effect unless agreed to and authorized in writing by Kyoto Computer Services.
By acknowledging all of the above at the time of making an appointment for service, the customer has indicated that he/she has read and understands, and agrees to the terms of Payment and services.
